The Role of Stakeholders in Schools with a Management
Committee
There is no legal requirement as to the composition of a
Management Committee that is not incorporated. Therefore it
is not uncommon to find that the only members of the
Management Committee are those appointed by the School
Sponsoring Body. As such the legal role in the management of
the school of such stakeholders as the principal, teachers,
parents and alumni is limited to whatever role conferred by the
Management Committee, this varying from school to school.
The Supervisor in such a school has a particular task and this is
defined in section 39 of the Education Ordinance. The
Supervisor has authority to conduct all correspondence on the
management of the school between the school and the EDB.
The Supervisor also has duties to give notice to the EDB.
1. if a person ceases to be a manager;
2. the supervisor or principal ceases to perform their respective duties,
3. any teacher commences or ceases to be employed to teach in the
school, or
4. if the Supervisor becomes aware of a change of particulars furnished
under the Education Ordinance with respect to any landlord or tenant
of the premises in which the school is operated .
The Supervisor can also be served with notice requiring the
Managers to prepare, execute and submit a written constitution
in accordance with which the school shall be managed for
approval.
Otherwise, the management committee of the school shall be
responsible for ensuring that the school is managed
satisfactorily, that the education of pupils is promoted properly,
and that the Education Ordinance is complied with.
